Welcome to personajewels.com (the “Site”), operated by Tempus Luxury, LLC. (“Persona Jewelry,” “we,” “us,” or “our”). These Terms & Conditions (the “Terms”) govern your access to and use of the Site, our online memorial-jewelry store, custom-design services, content, and any associated mobile or offline services (collectively, the “Services”). By visiting or using the Services, you (“you” or “User”) agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility & Account Security

• You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By using the Services, you represent that you meet this requirement.
• You agree to provide accurate, current, and complete information for all account registration, memorial data submission, and checkout forms, and to keep such information updated.
• You are responsible for safeguarding your account credentials. We are not liable for losses arising from unauthorized use of your account.

2. Memorial Customization & Biometric Material

• Submission License. When you upload, mail, or otherwise provide fingerprints, handwriting, ashes, images, or other memorial (“Biometric Memorial Data”) for personalization, you grant us and our production partners a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and create derivative works solely for the purpose of crafting, fulfilling, repairing, or remaking the ordered products.
• Authorization. You confirm that you have full legal right to submit the memorial material and that such submission does not infringe or violate another person’s rights. You further confirm that the deceased’s next of kin or legal representative has consented, where required by law.
• Irreversible Custom Work. Custom orders incorporating Biometric Memorial Data are uniquely handcrafted and therefore non-returnable and non-refundable once production begins, except for manufacturing defects (see Section 7 below).

3. Product Descriptions & Variations

We strive to display product colors, precious-metal tones, and engraving details accurately; however, each memorial piece is handmade and may vary slightly in finish, grain, or patina. Such variations are normal and not considered defects.

4. Pricing, Taxes & Payment

• All prices are shown in U.S. Dollars unless stated otherwise. We reserve the right to change prices at any time before you place an order.
• You authorize us (through our payment processor) to charge the payment method you provide for the total amount displayed at checkout, including applicable shipping costs, taxes, and duties.
• You are responsible for any customs fees or import duties required by your destination country.

5. Order Acceptance & Cancellation

• Your order is an offer to purchase. We may accept, decline, or place limits on quantities at our discretion, including after order confirmation, if we identify an error in price or availability.
• You may cancel a non-custom order prior to dispatch by emailing info@personajewels.com. Custom orders cannot be cancelled once production has started.

6. Shipping, Delivery & Risk of Loss

• Estimated production and delivery timelines are provided during checkout and in order confirmations. These are estimates and not guaranteed delivery dates.
• Title and risk of loss transfer to you upon our delivery of the product to the carrier.
• Please inspect packages promptly. Any shipping damage or order discrepancy must be reported within 5 calendar days of delivery.

7. Returns, Repairs & Limited Warranty

• Non-Custom Products: You may return unworn, non-custom pieces within 14 days of delivery for a refund, minus shipping, subject to our Return Policy.
• Custom Products: Custom-made items (e.g., fingerprint pendants) are final sale. If your piece arrives with a manufacturing defect, contact us within 30 days and we will repair or replace it at no charge.
• Limited Warranty: We warrant against material and workmanship defects for 12 months from delivery. This warranty excludes normal wear, scratches, tarnish, and damage caused by misuse or unauthorized repair.

8. Intellectual Property

All content on the Services—including designs, text, graphics, logos, photographs, videos, and software—is owned by or licensed to Persona Jewelry and protected by U.S. and international copyright, trademark, and other laws. You may not use, reproduce, or distribute any content without our express written permission, except as necessary to view the Site on your Device or share product images for personal, non-commercial purposes.

9. User Conduct

You agree not to:

• Violate any applicable law or regulation;
• Post or transmit content that infringes another’s intellectual-property or privacy rights, is defamatory, obscene, or otherwise objectionable;
• Introduce viruses, malware, or disruptive code;
• Use any data-mining, scraping, or robots to extract information from the Site;
• Impersonate any person or entity or misrepresent your affiliation with us.

10. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN SECTION 7, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERSONA JEWELRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) THAT GAVE RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Persona Jewelry, its directors, officers, employees, agents, affiliates, and production partners from and against any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your infringement of any third-party rights.

13. Governing Law & Dispute Resolution

These Terms and any dispute will be governed by the laws of the State of , U.S.A., without regard to its conflict-of-law provisions.

Binding Arbitration. Except for qualifying small-claims matters, you and Persona Jewelry agree to resolve any dispute arising under these Terms through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will take place in unless the AAA rules permit remote proceedings. You waive the right to a jury trial and to participate in a class action.

Nothing prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual-property or confidential-information rights.

14. Electronic Communications

By using the Services, you consent to receiving electronic communications from us (e.g., emails, SMS, push notifications). These communications may include notices about your account, orders, and promotional messages. You may opt out of marketing emails at any time via the unsubscribe link.

15. Modifications to the Services & Terms

• We reserve the right to modify, suspend, or discontinue any part of the Services at any time without liability.
• We may update these Terms from time to time. If we make material changes, we will post the revised Terms on the Site and update the “Last Updated” date. Continued use of the Services after changes become effective constitutes acceptance.

16. Miscellaneous

• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Severability. If any provision is found unenforceable, the remaining provisions will remain in full force.
• Entire Agreement. These Terms constitute the entire agreement between you and Persona Jewelry regarding the Services and supersede all prior agreements.
• Headings. Headings are for convenience only and do not affect interpretation.
