These Terms of Service govern your use of the Persona Jewelry website and your purchase of Persona Jewelry products. They also describe certain consumer-facing rules relating to memorial material and authorized memorial preservation records. Persona Jewelry is a brand of Tempus Luxury, LLC.

By using the Site or placing an order, you agree to these Terms and the policies incorporated by reference.

A separate Persona Family Fingerprint Authorization, where applicable, governs authorization for an approved Memorial Provider to collect and preserve fingerprint or other memorial material on Persona's behalf. Completing that authorization does not by itself require or create a jewelry purchase.

Please read Section 15 carefully. It contains an arbitration agreement and waivers of class actions and jury trials for consumer disputes. Section 16 explains that those provisions do not govern the separate Persona partner program where a written Partner Agreement is in place.

1. Who We Are

Persona Jewelry is a brand of Tempus Luxury, LLC, a Florida limited liability company with its business address at 133 NE 2nd Avenue, Unit 2013, Miami, Florida 33132, United States.

2. Using This Site

You must be at least 18 years old, or the age of majority where you live, to use this Site or place an order.

You agree to provide accurate information and not to misuse the Site, interfere with its operation, attempt unauthorized access, introduce malicious code, or use the Site for any unlawful purpose.

We may decline or cancel an order, suspend access, or refuse service for any lawful reason, including suspected fraud, misuse, pricing or product errors, inability to fulfill an order, or a violation of these Terms.

3. Made-to-Order Products and Personalization

Every Persona Jewelry piece is made to order for a specific customer. We may incorporate fingerprints, handprints, handwriting, signatures, photographs, names, dates, inscriptions, and similar memorial elements into a product.

You are responsible for reviewing the product selection, size, material, spelling, dates, names, engraving, and the quality and suitability of any material you submit before placing the order.

Once production begins, personalization details ordinarily cannot be changed.

4. Memorial Submissions, Preservation, and Your Authority

When you directly upload or provide a fingerprint, handprint, photograph, handwriting sample, signature, or other memorial material to Persona in connection with a product, you authorize Persona Jewelry and its approved production and service providers to use, reproduce, process, and store that material only as reasonably necessary to design, create, engrave, fulfill, inspect, repair, remake, support, or complete an authorized reorder of the product and to maintain related records as described in our applicable policies.

Where memorial material is collected and preserved through an authorized Memorial Provider under Section 5, the collection and preservation are also governed by the applicable Persona Family Fingerprint Authorization and our Biometric and Memorial Data Policy. An authorized preservation record may be created without an immediate jewelry purchase.

We do not use Biometric and Memorial Data for marketing, advertising, profiling, unrelated identification, or artificial intelligence or machine learning training. We do not sell, rent, license, lease, barter, trade, or otherwise profit from Biometric and Memorial Data.

When you directly submit memorial material to Persona, you confirm that you are the person to whom the material belongs or that you have lawful authority to provide the material and authorize its use for the stated purpose.

Additional rules governing collection, preservation, use, disclosure, security, retention, deletion, and requests are provided in our Biometric and Memorial Data Policy and Privacy Policy.

5. Fingerprint Preservation Through an Authorized Memorial Provider

Persona Jewelry may authorize a funeral home or other memorial professional under a written arrangement with us to collect or handle fingerprint or other memorial material on our behalf. In these Terms, we refer to an organization authorized to perform this role as a Memorial Provider.

An authorized Memorial Provider may collect or handle memorial material only through approved, location-scoped Persona tools and workflows and only for records assigned to the Memorial Provider location through which the record is created.

Authorization is required before fingerprint capture. We require a signed Persona Family Fingerprint Authorization, or equivalent auditable evidence of authorization, before a Memorial Provider captures a fingerprint on our behalf.

The person providing that authorization must represent that they have lawful authority to authorize the collection and preservation of the material. The Memorial Provider is responsible for determining under its own professional procedures and applicable obligations whether the required authorization has been completed by an appropriate person.

The Memorial Provider must separately confirm that the required authorization is in place before capture proceeds. Completion of a family signature or authorization record by itself does not permit the Memorial Provider to bypass that confirmation requirement.

Persona relies on the Memorial Provider's confirmation as an operational requirement for access to the fingerprint capture workflow. Persona does not, through that workflow, independently determine family hierarchy or adjudicate competing claims about who should act for the person whose material is being preserved.

Nothing in this process replaces a consent or authorization requirement imposed by applicable law.

No immediate jewelry purchase is required. Once the required authorization and Memorial Provider confirmation are in place, an eligible fingerprint may be captured and preserved in an authorized Persona record even if no product is purchased at that time.

If the family later chooses to place an eligible Persona Jewelry order, the preserved fingerprint record may be used for that authorized product purpose subject to the applicable authorization, retention rules, and product terms.

6. The Persona PIN

A Persona PIN is a unique reference code linked to an eligible fingerprint record created through a Memorial Provider location authorized by Persona Jewelry.

A Persona PIN links the eligible fingerprint record to the Memorial Provider location through which the record was created. A PIN may exist before any jewelry purchase is made.

If a later order uses that eligible fingerprint record, the Persona PIN helps connect the order to the correct record and attribute the order to the issuing Memorial Provider location.

A Persona PIN is not a coupon, discount code, or promotional code. It does not reduce the price of an order unless a separate promotion expressly says otherwise.

A fingerprint image submitted directly by a customer does not receive a Persona PIN and does not create Memorial Provider attribution.

You are responsible for entering a PIN accurately when a PIN is used in connection with an order. A PIN-entry error does not by itself create a right to a refund, cancellation, or change of attribution. Persona may correct a documented attribution error where its authoritative records support the correction and an appropriate audit trail is maintained.

7. Prices, Payment, Tax, and Shipping Charges

Prices are shown in U.S. dollars and may change before an order is placed. Payment is due when the order is submitted unless we expressly approve another arrangement in writing.

We may correct pricing, product, availability, or description errors and may cancel and refund an affected order.

Applicable tax and shipping charges are displayed at checkout before payment. The active shipping charge, free-shipping threshold, and related rules are provided in our Shipping and Delivery Policy.

8. Production, Shipping, Delivery, and Risk of Loss

Production and delivery timeframes are estimates rather than guaranteed delivery dates. Our current standard estimates are provided in the Shipping and Delivery Policy.

Persona Jewelry does not offer expedited production, expedited shipping, Funeral Express, rush service, or a guaranteed-delivery service.

Persona Jewelry bears the risk of loss and damage in transit until the carrier records the first verified delivery to the shipping address provided with the order.

If an order is confirmed lost in transit or arrives damaged in transit, we will investigate and provide the remedy described in the Shipping and Delivery Policy.

Visible transit damage, a visibly incorrect product, or a visible engraving error must be reported within five calendar days of first verified delivery.

If we cannot ship within the stated or otherwise agreed timeframe, we will provide the notice, delay option, cancellation, and refund required by applicable law for the unshipped merchandise.

9. Cancellations, Returns, Remakes, and Warranty

Because personalized products are made for a specific customer, they cannot ordinarily be returned or exchanged because of a change of mind.

An order cancelled before production begins is eligible for a full refund. Once production has begun, the order cannot ordinarily be cancelled.

A cancellation request is not effective until Persona Jewelry confirms whether production has begun and confirms the cancellation.

Our Limited Warranty covers eligible manufacturing defects for one year from first verified delivery. Visible transit damage, a visibly incorrect product, or a visible engraving error must be reported within five calendar days of first verified delivery.

10. Other Policies

Each policy governs its specific subject. These Terms govern subjects not addressed more specifically in another applicable policy.

11. Intellectual Property

The Site, brand, design, text, graphics, photographs, product images, logos, and other content are owned by Persona Jewelry or used with permission and are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, publish, sell, license, or commercially use Site content without prior written permission.

Your memorial material remains yours or subject to the rights of the person or estate to which it belongs. The limited permissions described in Sections 4 and 5 do not transfer ownership of the memorial material to Persona Jewelry.

12. Site and Product Availability

We aim to keep the Site available and accurate, but we do not guarantee uninterrupted access or that every description, image, price, or availability statement is free from error.

We may modify, suspend, withdraw, or discontinue a product, feature, or part of the Site at any time, subject to obligations for orders already accepted and applicable obligations relating to memorial records already entrusted to us.

13. Limits on Responsibility

To the extent permitted by applicable law, Persona Jewelry is not responsible for indirect, incidental, special, exemplary, or consequential losses arising from use of the Site or purchase of a product.

To the extent permitted by applicable law, Persona Jewelry’s total responsibility for a consumer order is limited to the amount paid for that order.

Nothing in these Terms excludes or limits a right, remedy, warranty, privacy right, data-protection obligation, or other responsibility that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so part or all of this Section may not apply to you.

14. Your Responsibility

You are responsible for reasonable losses and costs caused by your unlawful misuse of the Site, your material breach of these Terms, your direct submission of another person's material without authority, or materially incorrect personalization, address, or PIN information you provide.

This Section does not require you to cover losses caused by Persona Jewelry's own unlawful conduct, negligence, or breach.

15. Consumer Disputes

This Section applies to consumer purchases. It does not govern the Persona partner program described in Section 16.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise.

Contact us first. Before starting a formal proceeding, contact us at info@personajewels.com and give us 30 days to attempt to resolve the dispute.

Arbitration. If a consumer dispute cannot be resolved informally, it will be resolved by binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. Arbitration may take place in Miami-Dade County, Florida, or remotely as permitted by the applicable rules. Either party may bring an eligible claim in small claims court.

Class-action waiver. To the extent permitted by law, consumer claims must be brought individually and not as part of a class, collective, consolidated, or representative action or arbitration.

Jury-trial waiver. To the extent permitted by law, each party waives the right to a jury trial for a consumer dispute governed by these Terms.

A proceeding not subject to arbitration must be brought in a state or federal court located in Miami-Dade County, Florida, except where applicable law provides a non-waivable alternative.

16. Persona Partner Program: Separate Agreement

Persona Jewelry may enter into a separate written Partner Agreement with funeral homes and other professional memorial organizations that Persona authorizes as Memorial Providers.

These Terms do not govern the partner relationship where such a Partner Agreement is in place. If you are a partner organization, Memorial Provider location, or a person authorized by one of them and are acting in that capacity:

• Wholesale and direct ordering, commissions and attribution, equipment, location enrollment, authorized-user access, memorial preservation workflows, location-scoped record access, authorization responsibilities, fingerprint capture, and handling of memorial records are governed by the Partner Agreement and applicable Persona operating requirements

• The arbitration agreement, class-action waiver, and jury-trial waiver in Section 15 do not apply to a dispute arising under the Partner Agreement

• Nothing in these Terms or another Site policy limits, overrides, or amends the Partner Agreement

A Persona Family Fingerprint Authorization is a family-facing authorization relating to memorial material. It does not replace or amend the Partner Agreement governing the Memorial Provider's relationship with Persona.

If a person associated with a Memorial Provider separately places a personal consumer order, these Terms apply to that consumer order but do not override the Partner Agreement.

17. Changes to These Terms

We may update these Terms to reflect changes in our products, services, practices, technology, or legal requirements.

Material changes will be posted with an updated date. A change does not apply retroactively to an order already placed unless required by law or expressly agreed.

An update to these Terms does not by itself expand the purposes for which Persona may collect or use Biometric and Memorial Data. Material changes to the collection or use of that material are governed by the Biometric and Memorial Data Policy and applicable authorization requirements.

18. General Terms

If a provision of these Terms is found unenforceable, the remaining provisions continue in effect to the extent permitted by law.

A failure or delay in enforcing a provision is not a waiver.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms in connection with a merger, acquisition, financing, sale, or reorganization of the business, subject to applicable law.

These Terms and the policies incorporated by reference form the agreement governing your consumer use of the Site and purchases from Persona Jewelry.

Where memorial material is collected through an authorized Memorial Provider without an immediate purchase, the applicable Persona Family Fingerprint Authorization and the Biometric and Memorial Data Policy govern the authorization and preservation of that material. Completing a preservation authorization does not by itself create an obligation to purchase a Persona Jewelry product.
