PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE OR PLACING AN ORDER.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer" or "you") and Tempus Luxury, LLC, a Florida limited liability company doing business as Persona Jewelry ("Persona Jewelry," "we," "us," or "our"). These Terms govern your access to and use of https://www.personajewels.com (the "Site"), our products, and all related services. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, Return and Refund Policy, and Shipping Policy (each incorporated herein by reference). If you do not agree, do not use the Site or purchase our products.

1  Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to use the Site or place an order. By using the Site, you represent and warrant that you meet this requirement. We reserve the right to refuse service to anyone at any time for any lawful reason.

3  Memorial Submissions -- License and Authorization

3.1 Submission License

When you upload or provide fingerprint images, handprint scans, photographs, handwriting samples, signatures, or other memorial material (collectively, "Memorial Submissions") through the Site, you grant Persona Jewelry and its authorized production partners a limited, non-exclusive, royalty-free license to use, reproduce, modify, and process the Memorial Submissions solely for the purpose of designing, crafting, engraving, fulfilling, repairing, or remaking your ordered products.

3.2 Authorization and Consent

By submitting Memorial Submissions, you represent and warrant that:

•       You have full legal right and authority to submit the Memorial Submissions

•       For Memorial Submissions involving a living person other than yourself, you have obtained that person's informed consent

•       For Memorial Submissions involving a deceased individual, you are the legally authorized next-of-kin or legal representative, or you have obtained consent from such person, and such submission complies with all applicable laws

•       The submission does not infringe any third-party intellectual property, privacy, or other legal rights

•       Where required by applicable biometric privacy law (including the Illinois Biometric Information Privacy Act), you have provided or obtained the requisite written authorization prior to submitting biometric identifiers

Persona Jewelry operates on a consent-first model. We do not, and will not, instruct funeral home partners to collect fingerprints or biometric data without your prior knowledge and express consent. Persona Jewelry is not responsible for any unauthorized collection of biometric data by third parties.

3.3 Deceased Persons

By submitting the fingerprint or memorial data of a deceased individual, you represent that you are the legally authorized next-of-kin or legal representative and that no applicable law prohibits such submission and use for memorial jewelry production. You accept all responsibility for ensuring compliance with any applicable state or local regulations governing handling of decedents' biometric information.

4  Product Descriptions and Variations

Each memorial piece is handcrafted, and slight variations in color, finish, texture, grain, or patina are inherent to artisan production and are not considered defects. Displayed product images are representative only. Screen color rendering may differ from actual product appearance.

5  Pricing, Taxes, and Payment

All prices are in U.S. Dollars. We reserve the right to change prices before order placement. You authorize us or our payment processor to charge your designated payment method for the total amount at checkout, including shipping and applicable taxes. You are responsible for all customs duties, import taxes, and VAT required by your destination country. In the event a product is listed at an incorrect price, we reserve the right to refuse or cancel the order.

6  Order Acceptance

Your order is an offer to purchase. We may accept, decline, or limit any order in our sole discretion. A binding contract is formed upon our written order confirmation. We will notify you of any issues preventing fulfillment.

7  Custom Orders -- Non-Cancellable After Production Begins

Custom and personalized orders are non-cancellable and non-refundable once production has commenced. By placing a custom order, you acknowledge that the personalization details submitted at checkout are final, and you accept sole responsibility for their accuracy. Contact us at info@personajewels.com within twenty-four (24) hours of order placement if you need to request a correction.

8  Persona PIN System

A Persona PIN is a unique code associated with a fingerprint collected through a participating funeral home and registered with Persona Jewelry. When you enter a Persona PIN during product personalization, Persona Jewelry uses the PIN to locate and associate the corresponding fingerprint with your order.

By entering a Persona PIN, you represent that the PIN was provided to you or that you are otherwise authorized to use it in connection with the associated fingerprint.

Each Persona PIN is connected to the funeral home through which the fingerprint was collected. As a result, an eligible purchase made using the PIN may also be attributed to that funeral home in accordance with the applicable partner arrangement.

A Persona PIN is not a coupon, discount code, or promotional code. Any separate referral or promotional code offered under a specific partner arrangement will be identified separately.

Customers who do not have a Persona PIN may submit an existing fingerprint image directly through the product personalization process. Direct fingerprint uploads are not automatically assigned a Persona PIN.

You are responsible for entering the Persona PIN accurately. If a PIN cannot be validated or does not correspond with the intended fingerprint record, Persona Jewelry may contact you for additional information before production begins.

9  Shipping, Delivery, and Risk of Loss

Estimated production and delivery timelines are estimates only, not guaranteed delivery dates. Risk of loss and title transfer to you upon delivery to the carrier. Inspect deliveries promptly. Shipping damage or order discrepancies must be reported within five (5) calendar days of delivery.

10  Intellectual Property

All Site content -- including designs, text, graphics, logos, photographs, videos, and software -- is owned by or licensed to Persona Jewelry and protected by U.S. and international intellectual property law. You may not reproduce, distribute, or display any Site content without our prior written consent, except for personal, non-commercial viewing purposes.

11  Prohibited Conduct

You agree not to: (a) violate any applicable law; (b) infringe any intellectual property or privacy rights; (c) submit false, misleading, or unauthorized personalization information or Memorial Submissions; (d) misuse the PIN system; (e) introduce malware or disruptive code; (f) use automated tools to scrape or harvest Site data; or (g) impersonate any person or entity.

12  DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY SET FORTH IN OUR WARRANTY PROVISIONS, THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13  LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEMPUS LUXURY, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR THE PRODUCTS. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

14  Indemnification

You agree to defend, indemnify, and hold harmless Tempus Luxury, LLC, its members, officers, employees, agents, affiliates, and production partners from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Site; (b) your violation of these Terms; (c) your Memorial Submissions, including any unauthorized submission of another person's biometric data; (d) your violation of any third-party rights; or (e) incorrect personalization information or PIN entry.

15  SMS and Electronic Communications Consent

By providing your phone number and selecting SMS updates, you agree to receive transactional text messages from Persona Jewelry about your order, production status, shipping, delivery, and customer support. Marketing text messages require separate consent and are not a condition of purchase. Message and data rates may apply. Reply STOP to opt out and HELP for help. Standard message and data rates may apply. By using the Site, you consent to receiving electronic communications as described in our Privacy Policy.

16  Governing Law and Dispute Resolution

Governing Law.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Binding Arbitration.

Except for qualifying small claims court matters, all disputes arising out of or relating to these Terms or any purchase shall be finally resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Miami-Dade County, Florida, or remotely at the AAA's discretion. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY.

Jury Trial Waiver.

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING UNDER THESE TERMS.

17  Modifications to Terms

We may update these Terms at any time. Material changes will be posted on the Site with an updated "Last Updated" date. Continued use of the Site after changes constitutes acceptance.

18  Miscellaneous

•       Entire Agreement: These Terms, together with our Privacy Policy, Return and Refund Policy, and Shipping Policy, constitute the entire agreement between you and Persona Jewelry

•       Severability: If any provision is found unenforceable, the remainder continues in full force

•       No Waiver: Failure to enforce any provision is not a waiver of that provision

•       Assignment: You may not assign these Terms; Persona Jewelry may assign freely
